📌 Purpose

Phenom Elite is committed to handling all departures — voluntary or otherwise — with professionalism, respect, and thoroughness. This policy ensures a smooth transition that protects both the company and the departing team member.

🔴 Termination of Employment

For Cause

Phenom Elite may terminate employment immediately for cause, including but not limited to:

• Conviction of a felony or act involving moral turpitude
• Theft, fraud, dishonesty, or falsification of records
• Improper disclosure of confidential or proprietary information
• Actions that damage the company's reputation or business
• Failure to perform assigned duties after written notice and reasonable opportunity to correct
• Breach of agreement not cured within 8 days of written notice
• Gross incompetence or chronic unexcused absenteeism
• Misconduct, misappropriation of funds, or violation of law

Upon termination for cause, Phenom Elite's only obligation is to pay accrued but unpaid base salary and vacation to the date of termination.

Without Cause

Phenom Elite may terminate employment without cause at any time. In such cases, the employee is entitled to 4 weeks of severance pay (in addition to accrued salary and vacation), contingent upon signing a release of claims within 14 days.
